Seatbelts
Seatbelts save lives but accidents still happen. Most states now require seatbelts to be worn by law as they have a proven record of reducing serious injuries. In the past, defendant drivers who caused a car accident claimed the victim was partially responsible for their injuries by not wearing a seatbelt. At first, courts often agreed that the plaintiff (victim) failed to reduce their injuries, or “mitigate damages.” Today, the courts believe the victim made the decision to not wear a seatbelt before the accident, meaning the choice is not part of the mitigation of damages and the victim cannot be found negligent or partially responsible. The fault lies with the defendant driver.
